Definitions
All references to “Us”, “We”, “Our”, “Company”, “Bayside”, or “202 Bayside” mean Bayside, doing business as 202 Bayside.
All references to “You” or “Your” mean the person, persons, entity, entities, or authorized parties accessing or using the Company’s Services.

We collect Personal Information from you and the device(s) you use when you: use the Service(s), creating an account on the Site, provide information in the mobile application or on the web, update or add information to your account, or participate in communications or dispute resolution regarding the Service(s).

 Transaction information that you provide and that is generated in recording your transactions;

 Information you add to your account, provide in a web form, or communicate to Company or other account holders;
 Information about your device, interaction with the Service(s), and communications with Company which may include a unique device identifier, device type, identification (ID) for advertising;
 Information about the pages you view, the links you click, and other actions you take within the Service(s), emails and other communication with the Company.
Use of Personal Information
Company uses the collected information for the following general purposes: providing the Service(s), billing, identification and authentication, customer service and services improvement, contact, research, and detection and mitigation of fraud and illegal activities.
Your personal information is not sold to other entities for commercial purposes, except as required to facilitate your transactions as part of the Service(s), when we have your permission, and under the following circumstances:

 We may share your personal information with our authorized service providers and third party software solutions that perform certain services on our behalf. These services may include fulfilling orders, processing credit card payments, delivering packages, providing customer service and marketing assistance, performing business and sales analysis, supporting our website functionality and supporting features offered through our site. In addition, we may share information that you provide to us as well as information that we collect with third parties to serve you ads tailored to your interests on our site and on other websites.
 When it is necessary to share information to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to property or physical safety, violations of the Terms of Use, or as otherwise required by law.
 If Company is acquired by or merges with another company. In this event, Company will notify you before information about you is transferred if it will be subject to a different privacy policy.

Data Storage
We store your data in a secure manner in a restricted-access databases and affiliated third party software for means of completing service to you.  However, no data transmitted over the Internet can be guaranteed to be 100% secure, and WE DO NOT REPRESENT OR GUARANTEE THE SECURITY OF PERSONAL INFORMATION OR OTHER INFORMATION IN ANY FORM. Similarly, we disclaim liability for Personal Information submitted through our Site and you provide us with this data at your own risk. Our databases are located in the United States.  If you are outside of the US, you may be located in a region with laws or regulations governing personal data collection, use or disclosure that differ from US laws, which do not have the same data protection laws as the EU and other regions. By providing your data you consent to: (i) the use of your personal data for the uses identified above in accordance with the Privacy Policy; and (ii) the transfer of your personal data to the US as indicated above and the application of US laws to the collection, use and disclosure of your Personal Information.

Payment Information
We may collect and store any personal information you enter on our site or provide to us in some other manner. This includes identifying information, such as your name, address, email address, telephone number, billing and shipping addresses and financial information such as your payment method (valid credit card number, type, expiration date or other financial information). In addition, if you choose to use certain features of the Services, we may require you to provide additional personal information such as shopping preferences and demographics. Information provided to and collected by an affiliated partner to place an order (e.g., Square, Mailchimp, SpringBig, or any other e-commerce based site) is not our responsibility and may be shared with us provided it abides by and follows their privacy policy and terms and conditions. We may also collect and store personal information that you provide to us about other people.

Third Party Vendors and Links
The Company uses third party vendors, financial partners, and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to operate our Service(s). These third party vendors have their own terms of service/use and privacy policies that you should read. We are not responsible for the security or privacy of any information collected by other Sites or other services. You should exercise caution and read the third-party privacy policies to understand how the third parties collect, process, share and store your information.

Information from Social Media
When you interact with the Site through a social media platform (such as by clicking on a social media icon linked from the Site), we may collect the Personal Information that you make available to us on that page, including your account ID or username and other information included in your posts. If you choose to log in to your account with or through a social networking service, we and that service may share certain information about you and your activities.

Do we use Cookies? Yes.
Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser that enables the site’s or service provider’s systems to recognize your browser and capture and remember certain information. They are used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.
We may work with third-party service providers to assist us in better understanding our website visitors. These third-party service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

Privacy for Children
Our digital content and Service(s) may not be suitable for people under the age of 21. We do not knowingly allow users in this age group to receive services  on our Site, which are intended for users of 21 or older, or collect their Personal Information.

Changes
We may amend this Privacy Policy at any time by posting the amended terms at Company’s Site or application. The amended terms will take effect thirty days after they are posted. We will provide a notice of changes in the mobile application and/or by email to the address associated with your account.

To Stop Receiving Messages from us
If you wish to stop receiving messages from us, click on the “unsubscribe” link at the bottom of any message you receive from us. For SMS messages, text us “STOP”

Inquiries, Opt-out, Remove, or Modify your Information
To inquire, opt-out, remove or modify information you have provided us please contact the Company through our Aaron.burr@202bayside.com and alert us with your request. You can also do this thru the SpringBig software or thru Square.

Online Policy Only
This online privacy policy applies only to information collected through our website and not to information collected offline.

Acceptance of these Conditions
All visitors and users of our Site and Services have carefully read this document and consent and agree to its terms and conditions. If someone does not agree with this Privacy Policy, they should refrain from using our Site and Services. This Privacy Policy is an integral part of the Company’s Terms of Service.

Arbitration
This Privacy Policy is made in accordance with and governed by the laws of the District of Columbia. Any dispute arising out of this Agreement shall be resolved according to the procedures set forth in this Arbitration Section, which shall constitute the sole dispute resolution mechanisms hereunder. You agree to meet in person and/or telephonically to try in good faith to negotiate a resolution of any dispute. If the parties are unable to resolve any dispute(s) through such negotiation, the parties shall enter into binding arbitration. The arbitration shall be administered by JAMS Washington, D.C. Mediation, Arbitration and ADR Services or, if no longer in existence, another United States nationally-recognized administrator, and conducted in accordance with its comprehensive arbitration rules then in effect (the “Rules”). The arbitration shall be conducted in Washington, D.C. before a single neutral arbitrator appointed in accordance with the Rules.
